How long is sick leave in Spain?

In Spain, the duration of sick leave typically ranges from 12 to 18 months. Initially, sick leave is granted for a period of up to 365 days. This period can be extended by an additional 180 days if it is anticipated that the supported employee will fully recover during this time.

In the case of occupational sickness, sick leave can be extended by another 6 months. Thus, the total duration of sick leave can reach 18 months. If the supported employee has not recovered after 18 months, they may be considered permanently incapacitated and have the option to apply for a Social Security disability pension.

What are the eligibility rules for sick leave in Spain?

To qualify for sick leave in Spain, employees must meet the following criteria:

  • The employee must be registered with the social security system at the time of the illness or injury.
  • For non-occupational injuries ("Temporary Incapacity"), the employee must have a minimum of 180 days of contributions in the 5 years immediately preceding the application for sick leave.
  • For occupational sickness, there is no minimum contribution period required.

How is sick leave payment calculated in Spain?

In Spain, sick leave payment is structured as follows:

Non-Work-Related Illness or Injury

  • Days 1-3: Employees do not receive pay for the first 3 days of sick leave. However, it is Velocity Global Spain's practice to cover these days.
  • Days 4-15: Paid by the employer at 60% of the regulatory base.
  • Days 16-20: Paid by the social security system at 60% of the regulatory base.
  • Day 21 Onward: Employees are entitled to 75% of the regulatory base, paid by the social security system.

Occupational Illness and Accidents

  • From Day 1: Social security covers 75% of the regulatory base starting from the day after the sick leave begins.

What is the process for applying for sick leave in Spain?

To apply for sick leave in Spain, the supported employee must visit a Health Center where a doctor can inform Social Security about the employee’s condition. This step is essential in the process to officially request sick leave.
