In Romania, probationary periods, referred to as trial periods, are not mandated by law and are optional. However, if they are incorporated into employment agreements, the following limits apply:

  • For permanent employment agreements:
  • Up to 90 calendar days for non-management positions.
  • Up to 120 calendar days for executive or management positions.

  • For fixed-term employment agreements:
  • 5 working days if the agreement is for 3 months or less.
  • 15 working days for agreements between 3–6 months.
  • 30 working days for agreements over 6 months (non-management positions).
  • 45 working days for management positions.

Furthermore, for supported employees with disabilities, the probationary period must not exceed 30 calendar days.
