Employment Types and Agreements in Hong Kong

What types of employment agreements can be accommodated in Hong Kong (i.e., fixed-term, part-time, hourly, etc.), and what are the restrictions for each type? Does Pebl have templates available?

In the Hong Kong Special Administrative Region (SAR) of China, the following types of employment agreements are accommodated:

  • Indefinite Employment Agreements: These agreements do not specify an end date and are ongoing.

  • Fixed-Term Employment Agreements: Suitable for roles that require a predefined employment period.

  • Part-Time Employment Agreements: There are no specific legal restrictions for part-time employment, as Hong Kong law does not differentiate or specifically govern part-time employees. Provisions for part-time employment are included in the template employment agreement.

  • Hourly Employment Agreements: Similarly, Hong Kong law does not specifically govern hourly employees. Provisions for hourly employment are also included in the template employment agreement.

Is it necessary for the employment agreement to be bilingual with the native language taking precedence in Hong Kong, SAR China?

In Hong Kong, seniority can be recognized in employment agreements. This is achieved by including language in the employment agreement that specifies an earlier start date for the supported employee for the purposes of determining employment benefits and tenure.
