The additional 1.5 hours (from 40 to 38.5) are considered as additional work ("Mehrarbeit"), which is compensated on a 1:1 basis.

During secondment to a customer, the statutory provisions, CBAs, and other binding provisions related to working time and vacation applicable in the customer's company for comparable employees apply to the leased employees. Consequently, if the supported employee is on secondment, the normal weekly working hours may vary above or below 38.5, depending on the applicable CBA at the customer's location.
