Is there a statutory probationary period in Spain and can it be extended or removed? Can the probationary period differ for various job titles or employment agreement types?

In Spain, probationary periods are determined by the Collective Bargaining Agreement (CBA). The applicable CBA for consulting employees establishes the following probationary periods based on the Professional Group of the employee:

  • Group A: 6 months
  • Group B: 6 months
  • Group C: 6 months
  • Group D: 6 months
  • Group E: 3 months

Group E includes individuals who perform technical and administrative tasks of low complexity, subject to work instructions. These tasks are performed without autonomy and under supervision. Generally, a 6-month probationary period can be implemented for all employees, except for those in Group E who have a 3-month probationary period.

The probationary period can differ based on the job title or employment agreement type, as stipulated by the CBA.
