Yes, an employee's start date in China can fall on a weekend or public holiday.

Is there a statutory probationary period in China and can it be extended or removed? Can the probationary period differ for various job titles or employment agreement types in China?

In China, the statutory probationary period is determined by the nature and duration of the employment agreement and differs as follows:

  • For employment agreements with a term of less than 3 months or agreements that expire upon completion of specific work, no probationary period is permitted.
  • For agreements with a term of 3 months or more but less than 1 year, the probationary period can be up to 1 month.
  • For agreements with a term of 1 year or more but less than 3 years, a probationary period of up to 2 months is allowed.
  • For agreements with a term of 3 years or more, or for open-ended employment, the law allows a probationary period of up to 6 months.

There can only be one probationary period imposed for the duration of the employment. While the probationary period can vary based on the duration of the employment agreement, it cannot be extended or removed outside of these statutory limits.

Are employment agreements mandated to be registered with a regulatory authority in China? If yes, what is the process for registration?

In China, employment agreements are not required to be registered with a regulatory authority. However, for expatriates, it is necessary to provide a hard copy of the signed employment agreement for the Work Visa application.

The onboarding timeline for Velocity Global China includes several important steps:

  • Drafting the employment agreement takes 24 hours for our own entity, and 1-2 days for an In-Country Partner (ICP).
  • Collecting feedback from the supported employee requires 1-2 days.
  • Modifying the employment agreement as requested by the supported employee and obtaining re-approval from the customer takes an additional 1-2 days.
  • Completing the onboarding requirements by the supported employee generally takes 2-3 days.

It is recommended to allow a minimum of 7 days for the entire process to ensure the supported employee does not feel pressured when signing the employment agreement. In case of expatriates new to China who cannot perform online real-name verification, an additional week may be required to facilitate a wet signature and delivery of the employment agreement.
