How long is sick leave in Peru?
In Peru, sick leave is structured to support employees who have met specific social security contribution criteria. Employees are entitled to paid sick leave if they have contributed to social security for at least 3 consecutive months, or 4 months out of the 6 months before their incapacity began. Sick leave comprises the following components:
- Employees receive 20 days of paid leave per year for sickness or temporary disability, with the employer responsible for paying the employee during this period.
- Starting from the 21st day of medical leave, the Social Security in Health of Peru (EsSalud) provides a subsidy to the employee. Although the employer initially pays this subsidy from the 21st day, they can seek reimbursement from EsSalud at the end of the employee's leave.
- An employee can continue to receive sick leave benefits for up to 11 months and 10 consecutive days, or 540 nonconsecutive days spread over a 36-month period.
How is sick leave payment calculated in Peru?
In Peru, sick leave payment is managed as follows:
- The employer is responsible for paying the supported employee's full salary during the initial 20-day waiting period.
- After the 20-day waiting period, EsSalud pays a monthly benefit equal to 100% of the worker's average daily earnings from the last 4 months.
- This benefit from EsSalud can be received for up to 18 months.
