Other Types of Leave in Peru

What are the guidelines for emergency leave, including length, eligibility, application rules, and pay calculation in Peru?

Employees in Peru have several options for emergency leave, depending on their situation:

  • Time off for Dependents: Employees are entitled to a maximum of 7 days of paid leave if a child, parent, spouse, or partner is diagnosed with a serious or terminal illness or suffers a serious accident.

  • Leave for Cancer Treatment for Dependents Under 18: Employees may request up to 1 year of leave if they have a dependent under 18 years of age diagnosed with cancer. Pebl covers the first 21 days, and Social Security covers the remaining period.

  • Leave for Medical Assistance and Rehabilitation for Persons with Disabilities: Employees with a dependent who has a certified disability and requires medical assistance or rehabilitation are entitled to up to 56 hours of leave per year. This leave can be compensated with vacation days or overtime work.

  • Leave for Dependents with Alzheimer’s: Pebl grants 1 working day of paid leave per year for the care of a family member or dependent with Alzheimer’s. This leave can be taken in non-continuous hours, not exceeding the equivalent of one working day within the calendar year.

Eligibility:

  • Employees must demonstrate the relationship with the dependent requiring care.
  • Specific documentation may be required for each type of leave (e.g., medical certification).

Application Rules:

  • Employees should submit a formal request for leave according to the company's policies and provide necessary documentation.
  • Leave requests should align with the needs specified by the employee's dependent's condition and treatment requirements.

Pay Calculation:

  • For time off for dependents and Alzheimer’s leave, payment is provided by Pebl.
  • For cancer treatment leave, the first 21 days are paid by Pebl, and the remaining days by Social Security.
  • Leave for medical assistance and rehabilitation therapy may be compensated with vacation days or overtime work.
