Is there a statutory probationary period in the Czech Republic and can it be extended or removed? Can the probationary period differ for various job titles or employment agreement types in the Czech Republic?

In the Czech Republic, the statutory probationary period differs based on the type of employee. For non-managing employees, the probationary period can last up to 4 months, whereas for managing employees it is up to 8 months. It is possible to extend the probationary period, provided that it remains within the statutory limits and doesn't exceed half of the agreed duration of employment. For instance, if the employment relationship is agreed for 4 months, the probationary period cannot exceed 2 months.

Note that probationary periods agreed upon before June 1, 2025, follow the old rules of 3 months for non-managing employees and 6 months for managing employees. The probationary period can vary based on job titles, both in terms of duration and conditions, but must adhere to these legal standards.

Are employment agreements mandated to be registered with a regulatory authority in the Czech Republic? If yes, what is the process for registration?

The registration process is managed by the Managed Service Provider (MSP) and includes the following:

  • Social Security Reporting – ČSSZ: Employers must report new supported employees to the Czech Social Security Administration (ČSSZ) within 8 calendar days of the employment start date. This requirement is outlined in Act No. 187/2006 Coll., on Sickness Insurance.

  • Health Insurance Reporting – VZP or Other Insurer: Employers are also obligated to notify the relevant health insurance company (for example, VZP) of new supported employees within 8 days. This is required by Act No. 48/1997 Coll., on Public Health Insurance.
