In Luxembourg, employees may take paid sick leave starting from the first day of their illness or injury. The maximum duration for paid sick leave is 78 weeks within a 104-week period.

What are the eligibility rules for sick leave in Luxembourg?

In Luxembourg, the eligibility rules for sick leave are as follows:

  • In case of incapacity for work, the supported employee is obliged to notify the employer on the first day of absence. This notification can be given either orally or in writing according to article L. 121-6 of the Labor Code.
  • The employer must receive a medical certificate by the third day of absence at the latest.
  • The medical certificate must indicate the duration of the incapacity and the probable date of return to work.

How is sick leave payment calculated in Luxembourg?

In Luxembourg, the calculation of sick leave payment depends on whether the employee had access to their work schedule for the month in which the sick leave was taken:

  • Without Access to Work Schedule: If the employee did not have access to their work schedule for that month, they are entitled to a payment based on the average daily salary of the 6 months prior to the first day of sick leave.
  • With Access to Work Schedule: If the employee had access to their work schedule, they are entitled to their monthly base salary and any supplements they would have received had they worked during the sick leave as originally scheduled.

What is the process for applying for sick leave in Luxembourg?

When a supported employee in Luxembourg is unable to report to work due to illness or injury, the following process must be followed:

  • The supported employee must notify the employer on the first day of the absence.
  • A medical certificate verifying the illness or injury and specifying the anticipated length of the absence must be submitted by the supported employee no later than the third day of the absence.
