How long is sick leave in Chile?

In Chile, there is no fixed number of sick leave days. Sick leave can continue for as long as the medical condition persists, as long as it is supported by medical certificates. While there is no statutory limit on the total number of sick leave days, there is a maximum subsidized period of 52 weeks (1 year) for continuous sick leave or rest ("reposo").

What is the process for applying for sick leave in Chile?

To apply for sick leave in Chile, the supported employee who is ill and unable to attend work must:

  • Notify the company as soon as possible, either personally, through a third party, by email, or by telephone if email is not possible.
  • Provide notice to the company within 24 hours of the occurrence of the illness through the employee or a third party. The respective sick leave documentation must be presented within 2 business days after the illness occurs.
  • The computation of the time period begins from the first day of rest, irrespective of whether it is a business day.
  • Submit the corresponding Medical Leave Form in the format, timeframe, and conditions prescribed by Supreme Decree No. 3 of 1984, issued by the Ministry of Health. This form should certify its reception by the company and be accompanied by the necessary background information as established by the Decree.
