Other Types of Leave in Romania

What is the process and eligibility criteria for taking bereavement leave in Romania, and how is pay calculated?

In Romania, bereavement leave for supported employees is structured based on kinship and includes specific criteria for leave duration and remuneration:

  • Employees are entitled to up to 3 days of paid leave for the death of their partner, child, parent, or parent-in-law.
  • 1 day of paid leave is available for the death of a grandparent, brother, or sister.

Payment for bereavement leave is fully processed through payroll, and the duration of leave depends on the familial relationship with the deceased. Supported employees must provide a death certificate to facilitate payroll registration to receive this benefit. Paid bereavement leave is granted according to the guidelines outlined in the employee handbook.

To apply for bereavement leave, the supported employee must follow these steps:

  • Provide the death certificate of the relative.
  • Reach out to the HRx team through the Global Work Platform™ or by sending an email to support@hellopebl.com about the bereavement days.

What are the guidelines for emergency leave in Romania, including length, eligibility, application rules, and pay calculation?

Emergency Leave Guidelines in Romania

Right to Be Absent from Work:

  • Length: Employees have the right to be absent from work for up to 10 working days per calendar year.
  • Eligibility: This applies to situations caused by a family emergency due to illness or accident that makes the employee's immediate presence indispensable.
  • Application Rules: Employees must inform the employer prior to their absence. The period of absence must be recovered later, as agreed upon between the employee and the employer, to cover the normal work schedule.
  • Pay Calculation: The employee must recover the absentee period, implying that the absence is unpaid initially but compensated by working additional days later.

Carer's Leave:

  • Length: Carer's leave is for 5 working days per calendar year.
  • Eligibility: It is available to employees who need to provide care or support to a relative (son, daughter, mother, father, or spouse) or someone living in the same household with a serious medical problem.
  • Application Rules: Employees must submit a written request. Within 30 days of the request, the following documents must be provided:

- Proof of the relationship to the person needing care (e.g., identity card, birth certificate, marriage certificate).

- Proof of living in the same household (e.g., identity card showing the same address, residency documents, certificate from a homeowners/tenants association, or an affidavit).

- Medical documents proving the serious medical condition (e.g., hospital discharge note or medical certificate from the attending or family doctor).

  • Pay Calculation: During carer's leave, the employee remains insured in the social health insurance system without paying contributions, and the leave period counts towards both seniority in work and the specialty.

The list of serious medical problems qualifying for carer's leave is detailed in the annex to Order no. 2172/3829/2022.
