In Croatia, seniority can be recognized in employment agreements, but this recognition is limited to the terms agreed upon within the employment agreement itself and does not influence statutory entitlements.

For instance, if an employment agreement is terminated due to redundancy, the severance payment might be calculated based on the enhanced seniority recognized in the agreement. However, for tax relief purposes, only the actual period of employment with the Velocity Global entity is considered. It is important to differentiate between contractual recognition of seniority and statutory considerations.

Can variable compensation be included in the employment agreement in Croatia, or should it be outlined in a separate Variable Compensation Plan?

In Croatia, it is advised that the employment agreement should only reference the "Variable Compensation Plan as in force/applicable from time to time." The Variable Compensation Plan itself, along with any updates or amendments, should be delivered to the employee separately. This means while the employment agreement acknowledges the existence and applicability of the Variable Compensation Plan, the detailed terms and conditions of the plan should remain in a separate document.
